Terms of Service

1. The service

Skyfall provides advertising analytics and conversion attribution tools, including dashboards that display data from connected platforms such as Meta (Facebook) Ads and CRM systems. Features may change over time. We may add, modify, or discontinue functionality with reasonable notice where practical.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for maintaining the confidentiality of your account and for all activity under it. Sign-in is provided through Google OAuth; access may be restricted to authorized organizations or email domains at our discretion.

3. Integrations and third-party platforms

When you connect Facebook, a CRM, or other third-party services, you authorize Skyfall to access data from those platforms solely to provide the service. You represent that you have the right to connect each account and that your use complies with the third party's terms and applicable law.

We are not responsible for third-party platform outages, API changes, rate limits, or data accuracy outside our reasonable control.

4. Acceptable use

You agree not to:

• Use Skyfall for unlawful, fraudulent, or abusive purposes
• Attempt to gain unauthorized access to our systems or other users' data
• Reverse engineer, scrape, or overload the service except as permitted by law
• Misrepresent your identity or affiliation when connecting integrations
• Resell or sublicense the service without our written permission

5. Subscriptions and trials

Some plans may include free trials or paid subscriptions. Pricing, billing cycles, and cancellation terms will be presented at checkout or in a separate order form. Unless stated otherwise, trials convert to paid plans at the end of the trial period if not canceled.

6. Intellectual property

Skyfall, its software, branding, and documentation are owned by Skyfall Analytics, Inc. or its licensors. You retain ownership of your data. You grant us a limited license to host, process, and display your data as needed to operate the service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. METRICS AND REPORTS ARE FOR INFORMATIONAL PURPOSES; YOU ARE RESPONSIBLE FOR BUSINESS DECISIONS BASED ON THEM.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYFALL ANALYTICS, INC. AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Indemnification

You will defend and indemnify Skyfall Analytics, Inc. against claims arising from your use of the service, your connected integrations, or your violation of these Terms or applicable law.

10. Termination

You may stop using Skyfall at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons. Upon termination, your right to use the service ends; we may delete account data after a reasonable retention period unless law requires otherwise.

11. Changes

We may update these Terms. Material changes will be posted at https://skyfall.agency/terms with an updated effective date. Continued use after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Delaware, unless otherwise required by applicable consumer protection law.
